Welcome to ELIANA LUXURY. These Terms & Conditions (“Terms”) govern your use of our website at www.elianaluxury.com (the “Site”) and your purchase of products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully before using the Site.

ELIANA RELOVED LUXE LIMITED (trading as Eliana Luxury) is a United Kingdom luxury resale boutique specialising in authenticated pre-owned designer handbags, watches, shoes, jewellery and accessories.

By using the Site or placing an order, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding contract, and that the information you provide is accurate and complete.

2. Orders & Contract

All orders placed through the Site are subject to acceptance and availability. A contract between you and Eliana Luxury is formed only when we send you an order confirmation email. We reserve the right to decline any order, cancel orders suspected of fraud, or refuse orders that breach these Terms.

2.1 Order Accuracy

You are responsible for ensuring that all details provided at checkout are accurate and complete. We are not liable for delays or non-delivery resulting from incorrect information provided by you.

2.2 Availability

As we specialise in one-of-a-kind pre-owned items, each piece is unique. Once an item is sold, it is removed from the Site. In the unlikely event an item becomes unavailable after your order is placed, we will notify you promptly and issue a full refund.

2.3 Payment

We accept secure payment methods as displayed on the Site. Payment must be received in full before dispatch. All transactions are processed via encrypted, PCI DSS-compliant payment providers.

2.4 Ownership

Title and ownership of goods passes to you once payment has been received in full and the goods have been delivered to the address provided at checkout.

2.5 Cancellations

Orders may be cancelled prior to dispatch by contacting us immediately. Once an order has been dispatched, our Returns Policy (Section 6) will apply.

2.6 Pre-Orders and Waitlists

Where applicable, pre-order or waitlist items are subject to separate terms communicated at the time of listing.

3. Pricing

3.1 All prices displayed on the Site are shown in the currency selected at checkout and are inclusive of applicable taxes unless otherwise stated.

3.2 We make every effort to ensure pricing is accurate. If we discover a pricing error, we will contact you to confirm whether you wish to proceed at the correct price or cancel your order.

3.3 We reserve the right to change prices at any time without notice. Changes will not affect orders for which we have already sent a dispatch confirmation.

3.4 Promotional discounts and gift cards cannot generally be combined unless explicitly stated.

3.5 Our pricing reflects factors including original retail value, condition, rarity, demand, and market comparables, and does not constitute an official valuation for insurance or resale purposes.

4. Authenticity

4.1 Authentication Process

Every item listed for sale undergoes an authentication process conducted by trained specialists and, where applicable, third-party authentication services, prior to being listed.

4.2 Authenticity Guarantee

We guarantee that every item sold through the Site is authentic. If you believe an item is not authentic, contact us within 7 days of delivery with supporting evidence. If authenticity cannot be confirmed, we will provide a full refund including original shipping costs.

4.3 Condition Grading

Pre-owned items may show signs of previous use consistent with their stated condition grade. Condition grades and descriptions are provided in good faith. Photographs represent the actual item wherever possible.

4.4 Limitation

5. Shipping

5.1 Dispatch and delivery times are estimates only and may be affected by factors outside our control.

5.2 Orders are shipped using tracked and insured courier services. A signature may be required upon delivery.

5.3 Risk of loss and title passes to you upon delivery to the address provided at checkout.

5.4 Shipping costs are non-refundable except where required by law or where the return is due to our error.

5.5 We are not responsible for delays resulting from incorrect information provided by you at checkout.

6. Returns & Refunds

6.2 Return Window

Items may be returned within 14 days of delivery provided the item is unused, unworn, and returned in its original condition with all accessories and packaging.

6.3 Non-Returnable Items

Items marked as Final Sale are not eligible for return except where the item is not as described or not authentic. Gift cards are non-refundable.

6.4 Return Process

Contact our client service team within the applicable return window. Items returned without prior authorisation may not be accepted.

6.5 Refunds

Approved refunds will be issued to the original payment method following receipt and inspection of the returned item.

6.6 Faulty or Misdescribed Items

Contact us within 14 days of delivery. We will arrange a return at our cost and provide a full refund or replacement where available.

6.7 This Section does not affect your statutory rights under the UK Consumer Rights Act 2015.

7. International Orders

7.2 Customs, Duties, and Taxes

International orders may be subject to import duties, customs fees, and local taxes. These charges are the responsibility of the customer and are not included in the price or shipping cost shown at checkout.

7.3 We are not responsible for delays caused by customs processing.

7.4 We reserve the right to refuse shipment to certain destinations where required by law or where delivery security cannot be verified.

7.5 International customers are responsible for return shipping costs and customs documentation except where the return is due to our error.

8. Intellectual Property

8.1 All Site content including text, graphics, logos, images, and photography is the property of Eliana Reloved Luxe Limited or its licensors and is protected by applicable intellectual property laws.

8.2 The “Eliana Luxury” name, logo, and associated branding are trademarks of Eliana Reloved Luxe Limited. You may not use or reproduce our branding without prior written consent.

8.3 Eliana Luxury is an independent reseller of pre-owned goods and is not affiliated with, endorsed by, or sponsored by any original brand manufacturers unless explicitly stated.

9. Liability

9.1 To the fullest extent permitted by law, Eliana Luxury shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of any item.

9.2 Nothing in these Terms shall exclude our liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under applicable law.

9.3 Our total liability in respect of any order shall not exceed the total amount paid by you for the item(s) in question.

10. Governing Law

10.1 These Terms shall be governed by the laws of Scotland and the United Kingdom. Disputes shall be subject to the jurisdiction of the courts of Scotland, except where mandatory consumer protection laws of your country provide otherwise.

10.2 EU-based consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms

We reserve the right to amend these Terms at any time. The latest version will always be published on this page. Continued use of the Site following any changes constitutes acceptance of the revised Terms.
